The petition on behalf of Gautam Navlakha said that the charge sheet was not filed within 90 days of the arrest.

Earlier, the High Court had admitted that he was arrested and kept at home for 34 days. The 90-day limit does not apply in this case.

On 28 August 2018, Navlakha was arrested by the Pune Police but kept on house arrest from August 28 to October 1, 2018, instead of detaining him.

He is currently lodged in Taloja Jail in Navi Mumbai. Navlakha challenged the July 12, 2020 order dismissing the bail application by a special NIA court in the High Court last year.

He sought default bail on the basis of spending 90 days in custody and non-filing of charge sheet by the prosecution during this period. Earlier, the Delhi High Court had dismissed Navlakha’s detention as illegal on October 1, 2018.
