BHC on Monday dismissed the bail plea of ​​Gautam Navlakha. Gautam Navlakha did not even get bail from BHC in the Elgar Parishad case.

The Bombay High Court on Monday dismissed the bail plea of ​​Gautam Navlakha, accused in the Elgar Parishad case involving the Maoists, stating that he saw no reason to interfere in the logical order of the special court.

The special court has already rejected his bail plea. A bench of Justices SS Shinde and MS Karnik said that 34 days spent in house arrest in 2018 cannot be counted for statutory bail.

Navlakha was arrested by the Pune police on August 28, 2018, but he was not detained.

He was under house arrest from August 28 to October 1, 2018. He is currently in judicial custody at Taloja Jail in Navi Mumbai.

Navlakha challenged the July 12, 2020 order dismissing the bail application by a special NIA court in the BHC last year.

He sought statutory bail on the basis of spending 90 days in custody and the prosecution not filing charge sheets. Earlier, the Delhi High Court had dismissed Navlakha’s detention as illegal on October 1, 2018.

Demand for action against the organizers of Elgar Parishad

Maharashtra BJP has demanded action against the organizers of the event for ‘supporting’ anti-Hindu statements of speaker Sharjeel Usmani at the recently held Elgar Parishad. BJP spokesperson Keshav Upadhyay tweeted that the Elgar Parishad is working to divide the society.

Aligarh Muslim University alumnus Sharjil Usmani is accused of making derogatory remarks against Hindutva at the Elgar Parishad program.

On February 2, the Pune police registered a case against Usmani under Section 153A (causing enmity between two communities on the basis of religion) on a complaint by a BJYM leader.

Meanwhile, the state Deputy Chief Minister Ajit Pawar said that the government would consider banning people like Sharjeel Usmani from speaking at an event.

He said that former magistrates were also present in the Elgar Parishad, they should have stopped Sharjeel. In this case, strict action will be taken based on the FIR registered.
