CBI presented wrong facts in the HZL case: Govt.

The central government has withdrawn its petition seeking quashing of the Supreme Court’s direction to conduct a CBI inquiry into the decision to sell a government stake in state-owned HZL,

The government said that the grounds given by the CBI for filing the petition to withdraw the directions are not factually correct.

On November 18, 2021, the Supreme Court had directed the CBI to file a regular suit to investigate the HZL stake sale case and proceed in accordance with the law.

An application was filed by the government seeking to withdraw this direction of the court. In 2002, the government sold its 26 percent stake in state-owned HZL.

CBI presented wrong facts: A bench of Justices DY Chandrachud and Surya Kant allowed Solicitor General Tushar Mehta’s request to withdraw the government’s plea.

Mehta said that the government will look into taking recourse to other legal options including a review of this order. After this, the court dismissed this application giving information about the withdrawal.

During the hearing, the bench said, ‘This is an application to withdraw the petition. You are saying that the Court has seen enough material to file a regular suit.

But now I will establish before you that there is no sufficient material for the registration of a regular case. Actually, you are describing this case as contradictory?

This cannot become a ground for withdrawing the application. To this, Mehta said that the basic facts presented by the CBI are factually incorrect.

At the same time, he described the application for withdrawal of the petition as ‘urgent, just and worth considering’.

To this, the court said, ‘The Solicitor General is allowed to withdraw the petition. He is free to review the order and take other legal options in this matter.
