Displaced Kashmiris cannot keep government accommodation for life after retirement, important remarks of Supreme Court
The Supreme Court on Monday said displaced Kashmiri government employees cannot retain government accommodation for more than three years after retirement.
There can be no justification for allowing them to stay in government accommodation indefinitely on the basis of social or economic criteria.
A bench of Justices Hemant Gupta and AS Bopanna observed that the Office Memorandum to this effect is completely arbitrary and discriminatory as well as unconstitutional.
The top court said that government accommodation is meant for serving officers and employees and a government servant or his spouse cannot live there for life.
The bench said that if Kashmiri migrants are allowed government accommodation for a period of three years from the date of retirement.
We consider it appropriate as this period is being given to make alternative arrangements.
