Delhi Court Rejects Bail Application Of Gulfisha And Tasleem

Delhi Court rejects bail application of Gulfisha and Tasleem accused in riot conspiracy, read a comment: Delhi Riots.

On Wednesday, the Karkardooma Court refused bail to the accused, Gulfisha Fatima and Tasleem Ahmed, arrested under the Unlawful Activities Prevention Act (UAPA) on charges of conspiracy to commit Delhi riots.

The court of Additional Sessions Judge Amitabh Rawat, seeing the facts and evidence of the prosecution, agreed that it was not proper to grant bail to both of them.

Advocate Mehmood Pracha, while appearing in the court on behalf of the accused Gulfisha Fatima and Tasleem Ahmed, on their bail application, had said that both of them do not face charges under the Unlawful Activities Prevention Act.

Arguing on Gulfisha’s application, Pracha had said that the screenshots of WhatsApp chats against her client in the charge sheet cannot be accepted as evidence as they have not been authenticated.

In support of his contention, it was argued that such material without certification cannot be considered valid under the Indian Evidence Act.

Pracha had also insisted that the police have not been able to recover the mobile of Gulfisha, yet the charge sheet mentions her contact with other accused through mobile.

On this, Special Public Prosecutor Amit Prasad told the court that on the basis of the Call Detail Record (CDR) of her mobile number and information received from the mobiles of other accused, her contacts have been mentioned in the charge sheet.

He had told about the role of Gulfisha in the conspiracy through chat and the statements of confidential witnesses.

Delhi Court rejects bail application: Let us inform you that during the riots in North East Delhi in February 2020, 53 people were killed, while more than 700 people were injured.

The Delhi Police had claimed that the riots were organized as part of a conspiracy. Therefore, a separate case was registered against 20 people for conspiracy.

The accused in this case, Gulfisha Fatima was arrested on 11 April 2020 and Tasleem Ahmed on 24 June 2020.
