ISRO Espionage Case: Anticipatory bail of four accused canceled, Supreme Court directs High Court.

The Supreme Court has set aside the Kerala High Court order granting anticipatory bail to four persons in the 1994 ISRO espionage case related to the alleged framing of scientist Nambi Narayanan.

The Supreme Court has asked the High Court to decide on the plea of ​​the accused afresh within four weeks. The Supreme Court has directed that the accused shall not be arrested for five weeks.

A bench headed by Justice MR Shah remanded the bail pleas back to the Kerala High Court and asked it to decide the same at the earliest, within a period of four weeks.

The CBI had challenged the Kerala High Court order granting anticipatory bail to the five people. The division bench of the apex court had reserved the order on November 28.

The Supreme Court, while reserving the judgment, had indicated that the matter may be sent back to the Kerala High Court for re-examination.

The CBI has challenged the bail granted by the Kerala High Court to the accused, including former Kerala DGP Sibi Mathews.

The other accused in the case are PS Jayaprakash, Thampi S Durga Dutt, Vijayan, and RB Sreekumar.

What is the whole matter?

Aerospace engineer Nambi Narayanan, who hails from Tamil Nadu, was heading ISRO’s Cryogenics Department when he was embroiled in an espionage scandal.

In November 1994, Nambi Narayanan was accused of sharing some confidential information related to India’s space program with foreign agents.

Nambi Narayanan was arrested by the Kerala Police in 1994. He was engaged in making indigenous cryogenic engines. He was accused of selling indigenous technology to foreigners.

Later in the CBI investigation, this whole matter turned out to be false. After his vindication in 1998, Narayanan fought a long battle to get the police officers who framed him to act.

Hearing the matter, the Supreme Court in 2018 ordered a compensation of Rs 50 lakh to him.

Also, former judge Justice DK Jain was appointed to consider action against police officers who falsely implicated him in espionage.
