Most Of The State Governments Are Banning The Entry Of CBI

Most of the state governments are banning the entry of CBI. CBI’s problem, the central government should remove the discrepancy.

It is natural for the central government to feel helpless over the attitude of the states and especially the non-BJP ruled states regarding the Central Bureau of Investigation, but expressing its compulsion on its part is not the solution to the problem.

The central government has to look into the reasons why one after the other state governments are preventing the CBI from investigating their cases.

It is not right that the number of such states is increasing which are not allowing CBI to enter and investigate any case.

Most of the state governments are banning the entry of CBI without its permission saying that it is misused and also used for political purposes.

Generally, on such allegations, the central government’s argument is that the CBI is an autonomous investigating agency and has no political interference in its work.

But it cannot be ignored that this investigation agency has been given a caged parrot by the Supreme Court.

Apart from this, it is also a fact that in the past there has been political interference in the working of this agency. Many times this interference has also been seen.

Due to this, the reputation of CBI has come under threat and its credibility has not been maintained as it should be.

The record of the CBI in the investigation of various cases is also not very good and perhaps this is the reason why the Supreme Court had recently said that it will review its functioning.

I don’t know when this will happen and whether the situation will improve or not. It would be appropriate for the Central Government to realize that a major flaw lies in the way the CBI is constituted.

This agency was formed by an administrative order under the Delhi Special Police Establishment Act. This discrepancy should be removed.

After all, when this agency does not have the desired constitutional status, then how can it get real autonomy.

It also needs to be understood that the provisions of the administrative order under which the CBI was constituted make the consent of the states mandatory.

The states are also using this right arbitrarily. In some cases, they themselves demand a CBI inquiry, and in some cases, rejecting such a demand, they call this investigating agency a political weapon.

At a time when the scope of CBI’s investigation is increasing and it is necessary to have a competent central agency to investigate corruption and serious cases in the country.

Then the reasons should be addressed, due to which the state governments are obstructing the CBI investigation.
