SC On Hate Speech: Supreme Court reprimanded. Hate speeches spoil the atmosphere of the country, need to stop.

The Supreme Court slammed the government for curbing hate speech and said that no action is being taken against hate speeches.

A bench of Supreme Court Chief Justice UU Lalit and Justice S Ravindra Bhat said during the hearing of a petition that no action was being taken by the government on the need to immediately stop hate speech.

At the same time, in a separate case, the Supreme Court on Monday sought answers from the Uttarakhand and Delhi governments.

As to the action taken by the police against those who gave hate speeches at the Parliament of Religions held in the state and national capital last year.

At the same time, the petitioner Harpreet Mansukhani appeared in person in court regarding the hate speech.

He said that hate speech was used to make a statement to make India a Hindu Rashtra before the 2024 general elections.

Hate speech turned into a profitable business.

The Bench remarked, “You are right that the entire atmosphere is getting spoiled by these hate speeches and this needs to be stopped.”

Petitioner Harpreet Mansukhani, appearing in person, said that before the 2024 general elections, hate speech was given to make India a Hindu Rashtra.

“Hate speech has been turned into a profitable business. One party funded the Kashmir files and then I have proof of how it was funded and then made tax-free.

Hate speech is like an arrow.

The petitioner said that hate speech is like an arrow that once released from command cannot be taken back.

At the same time, CJI Lalit said, ‘To take cognizance in such cases, the court needs factual background. We need some examples. Otherwise, it is like a random petition.

To this, the petitioner, on his part, said that an affidavit would be filed on his behalf citing instances of hate speeches in which criminal cases were not registered.

Affidavit to be filed by October 31 – SC.

The Bench granted time to the petitioner to submit an additional affidavit focusing on certain incidents and to give details of the offense under consideration regarding the steps taken during the investigation.

The petitioner can also give details as to whether offenses were registered and who are deemed to be offenders. The court said that the affidavit should be filed by October 31.

When will the case be heard?

The CJI said, ‘We need a factual background for a court to take cognizance of this. We need some samples of cases. Otherwise, it is a random petition.

The petitioner had then said that he would file an affidavit citing instances of hate speeches and whether offenses were not registered. The bench agreed and adjourned the matter to November 1.
