SC refused to hear a plea against the law illegal conversion, know what the top court said. The SC on Wednesday refused to hear a new petition challenging the laws made in Uttar Pradesh and Uttarakhand to prevent conversion under the garb of marriage, inducement, etc.
The Supreme Court said that such cases are pending in the High Court of Uttar Pradesh and Uttarakhand and the petitioner should go there itself. A three-member bench headed by Chief Justice SA Bobde said this on a petition by an NGO.
The petitioner should go to the high court
A three-member bench headed by Chief Justice SA Bobde refused to consider the petition filed by the NGO PUCL (People’s Union for Civil Liberties), saying the issue raised in the petition was important.
The Allahabad High Court and the Nainital High Court are hearing this issue, in which case the petitioner should also go to the High Court.
There will be a chance to know the view of the High Court
The bench said that he is not commenting on the merit of the case but when the matter is pending in the High Court, he will also get an opportunity to know the view of the High Court.
Senior advocate Sanjay Parikh, appearing on behalf of the petitioner organization, told the bench that the Supreme Court has already given notice on some such petitions, in which case their petition should be attached for hearing along with the same case.
Challenge the illegal conversion law
Parikh said his petition challenged the illegal conversion laws of Uttar Pradesh and Uttarakhand. Under these laws, innocent people are being prosecuted but the bench did not agree to hear their plea and asked them to go to the High Court.
Interim stay denied
Earlier on January 6, the Supreme Court had issued notices considering the two petitions challenging the law to prevent the illegal conversion of Uttar Pradesh and Uttarakhand. However, the court refused to impose an interim stay on the law.
