Supreme Court’s decision on Abu Salem’s petition on July 11, has challenged the sentence of life imprisonment.

The Supreme Court will pronounce its verdict on July 11 on a plea by 1993 Mumbai blasts convict Abu Salem, challenging the life sentence awarded to him by SC.

In Salem’s petition, the life imprisonment has been challenged on the ground that as per the assurance given by India to Portugal at the time of his extradition in the year 2002, the sentence given to him cannot exceed 25 years.

According to the cause list of July 11 uploaded on the apex court’s website, a bench of Justices SK Kaul and Justice MM Sundaresh will pronounce the verdict on that day.

The apex court had on May 5 reserved its verdict in the matter, in which the Center had argued that the judiciary was independent of the solemn sovereign assurance given to the Portuguese government during Salem’s extradition in 2002 and it was up to the executive to take a decision on this at the appropriate level.

Supreme Court’s decision on Abu Salem: What did the Center say in its argument?

Additional Solicitor General KM Natraj, appearing for the Centre, told the court that the government was bound by the solemn sovereign assurance given by the then Deputy Prime Minister LK Advani to the Portuguese government and it would abide by it in due course.

He had argued that the court was not bound by this assurance and it could pass orders in accordance with the law. “The solemn sovereign assurance cannot be imposed on the judiciary.

The executive will take action on this at the appropriate level. We are bound by this assurance, but the judiciary is independent, it can proceed according to the law.

‘Sentence should be reduced from life imprisonment to 25 years.

The bench told Natraj that it was the submission of advocate Rishi Malhotra, representing Salem, that the court should decide on this solemn assurance and reduce his sentence from life imprisonment to 25 years or direct the government to give that assurance.

Nataraja had argued that there are judgments to the effect that life imprisonment means the whole life and there can be no exemption.

Malhotra had argued that the assurance was in clear words that if Salem is extradited by Portugal to trial in India, he will not be sentenced to death or to imprisonment for more than 25 years.

257 people were killed in the 1993 Mumbai blasts.

On February 25, 2015, a special TADA court sentenced Salem to life imprisonment in another case of the 1995 murder of Mumbai-based builder Pradeep Jain along with his driver Mehndi Hassan.

Salem, convicted of the 1993 Mumbai serial blasts, was extradited from Portugal on November 11, 2005, after a long legal battle.

In June 2017, Salem was convicted and later sentenced to life imprisonment for his role in the 1993 Mumbai serial blasts.

On March 12, 1993, 12 explosions were carried out one after the other in the country’s commercial capital Mumbai in about two hours.

In this attack, 257 people were killed and 713 people were seriously injured.
