Supreme Court’s Strictness On Criminals, Quashed The Bail

Supreme Court’s strictness on criminals, said – while granting bail to the courts, the record of the accused should be investigated.

The Supreme Court has said that while granting bail to an accused, courts should examine whether he has a bad record and whether he can commit serious offenses when released on bail.

With these observations, a bench of Justice Dhananjay Y Chandrachud and Justice MR Shah quashed the bail granted by the Punjab Haryana High Court to the accused facing charges of murder and criminal conspiracy.

The Supreme Court observed that the nature of the allegation and evidence are of utmost importance while deciding bail pleas on which the gravity of the conviction and sentence depend.

Referring to its earlier judgments, the apex court said that the purpose of depriving liberty by denying bail is based on the interests of justice.

It is logical to inquire about the past life of the accused who has filed the bail application. This helps in inferring that after coming out on bail, the accused will not commit serious crimes.

The Supreme Court made these observations on the Punjab-Haryana High Court’s decision to grant bail to an accused of murder and criminal conspiracy.

Supreme Court’s strictness on criminals: The Supreme Court heard the appeal against the said decision of the High Court.

The HC registered a case at Sadar Police Station, Jalandhar under sections 302 (murder), 120-B (criminal conspiracy), 34 (common intention), 201 (destruction of evidence) of the Indian Penal Code, and section 25 of the Arms Act, 1959.

In the case of the FIR lodged, the accused was granted bail, which was quashed by the Supreme Court.

The SC also observed that the Punjab and Haryana HC had not considered the nature of the charges against the accused and gravity of the sentence in the case of conviction as well as the evidence.
