Terror Funding Case: Instructions Of High Court To CIK

Terror Funding Case: Instructions not to make statements of protected witnesses public in Waheed Para’s case.

In the case of Waheed Para, the Division Bench of the High Court has directed Counter Intelligence Kashmir not to make public the statements of protected witnesses.

The bench set aside the trial court’s order directing the court to make public the enveloped statements of the protected witnesses.

Counter Intelligence Kashmir challenged this decision of the trial court in the Division Bench of the High Court.

During the hearing of the case, the Bench found that the trial court in its order dated June 1, 2021, has directed witnesses number one to five to produce their statements in a sealed cover, terming them as protected witnesses.

After this, on 11 September 2021, how can the trial court set aside its own decision and direct the statement to be made public?

The bench said that since it is a sensitive matter, by making public the statements of the protected witnesses, they cannot be put in danger.

Prohibition on action against the editor: The High Court has stayed the action initiated against the editor of a national news channel and others in a defamation case.

In this defamation case filed by PDP leader Naeem Akhtar, Chief Judicial Magistrate Srinagar issued a bailable warrant to the editor and directed him to appear before the court.

The editor challenged this in the High Court.

Terming it as a petty thing, the High Court said that when a person calls himself a public representative and becomes a leader, he should not react in such a way on trivial matters.

The High Court said that such people should consider it necessary to attack and sarcasm on themselves.

The High Court found that the editor or the TV channel had not done such a thing as to initiate a defamation case against him.

A case has been registered against the accused Arshad Ali, resident of Dansal, at Jhajjar Kotli police station for the attempt to murder and assault with a sharp weapon.
