After three decades, the cross examination of the Rubia kidnapping case begins, read what is the whole matter.
The cross-examination of witnesses began in a special court in Jammu on Saturday, three decades after the killing of four airforces personal in Kashmir and the kidnapping of Rubia Mufti Sayeed.
Rubia Sayeed is the daughter of the then Home Minister Mufti Mohammad Sayeed and sister of former Jammu and Kashmir Chief Minister Mehbooba Mufti.
Due to the non-appearance of several accused, the cross-examination was postponed for further hearing. The examination of the statements of the witnesses was started in the special court.
According to officials, prosecution witness Abdul Rehman Sofi and murder accused Salim alias Nanaji was present in the court.
While Yasin Malik of the banned Jammu and Kashmir Liberation Front, who has been charged in both the cases, joined the proceedings through video conferencing from Delhi’s Tihar Jail.
He told the court that he himself wanted to cross-examine the witnesses. He doesn’t want to take the help of a lawyer. Several other accused could not appear in court.
His lawyers cited the situation in Kashmir as the reason. After this, the court adjourned the arguments after some time.
In these cases, Monica Kohli, appearing as the Chief Prosecutor on behalf of the Central Bureau of Investigation (CBI), interrogated on behalf of the agency.
Kohli has been appearing for the CBI in the High Court as a retainer lawyer for seven years.
Yasin Malik is lodged in Tihar Jail. He was arrested by the National Investigation Agency in April 2019 in connection with the terror funding case.
When terrorists fired indiscriminately on 40 people:
Yasin Malik and six other accused are accused of killing four Air Force personnel on January 25, 1990, on the outskirts of Srinagar. The charges were framed on all of them on March 16 last year.
Apart from Malik, Ali Mohammad Mir, Manzoor Ahmed Sofi alias Mustafa, Javed Ahmed Mir alias Nalka, Shaukat Ahmed Bakshi, Javed Ahmed Zargar, and Nanaji are among others.
CBI had filed the charge sheet. According to the CBI, the terrorists opened fire on the jawans in which 40 people including a woman were seriously injured. Four soldiers were martyred in them.
Charges against 10 including Yasin Malik in Rubiya kidnapping case:
The court had on January 11 this year framed charges against Yasin Malik and nine others in the Rubia Saeed kidnapping case on December 8, 1989.
All of them were charged with murder, attempt to murder, and under sections of the now-defunct TADA Act.
The accused also include Ali Mohammad Mir, Mohammad Zaman Mir, Iqbal Ahmed, Javed Ahmed Mir, Mohammad Rafiq.
Manzoor Ahmed Sofi, Wajahat Bashir, Mehraj-ud-din Sheikh, and Shaukat Ahmed Bakshi.
Rubiya was kidnapped by the terrorists when she left for home after completing her duty from Lalded Hospital. In exchange for Rubiya, the terrorists had demanded fellow terrorists.
