The Physical Hearing Will Start Again In The Supreme Court

The physical hearing will start again in the Supreme Court, after a year and a half, guidelines issued.

The physical hearing has been closed in the Supreme Court for almost one and a half years due to the Corona epidemic. That is, during this hearing was done through video conferencing.

Now the physical hearing is being started again. SOPs have been issued for hybrid hearing.

According to this, all cases on Wednesday and Thursday will be heard only in the presence of the counsels/parties in the court.

CBI pleads with the Supreme Court, the obstruction in the investigation coming due to the withdrawal of the general consent of the states

The CBI has told the SC that the decision of various state governments to withdraw their general consent to probe the agency is proving detrimental not only to the investigation but also to the prosecution of cases.

CBI Director SK Jaiswal informed the SC in an affidavit that 8 state governments – Bengal, Maharashtra, Kerala, Punjab, Rajasthan, Jharkhand, Chhattisgarh, and Mizoram – have withdrawn the general consent.

He said that now it takes a lot of time to get specific consent on a case by case basis and at times it can be detrimental to time-bound and speedy investigation.

He said that out of 150 requests sent to these state governments, only 18 percent have been approved and most of the pending cases are related to bank frauds.

Refusal to give general order of appointment of CBI Director.

The Supreme Court on Wednesday said it cannot issue a general order for the appointment of a CBI director.

Non-Governmental Organization (NGO) Kaman Kaj argued that there should not be ad-hoc management till the successor is appointed after the expiry of the term of the CBI director.

But the current director should be retained. On this, Justice L. Nageswara Rao and Justice BR Gavai asked Attorney General KK Venugopal to file a reply.

ATS investigation valid till NIA takes over.

The Supreme Court on Wednesday upheld the Bombay High Court’s decision that the ATS Nanded was not restrained from conducting its investigation till the NIA Mumbai took over the investigation into the arrest of a suspected IS operative in Maharashtra.

The top court was hearing the appeal of Nasser bin Abu Bakr Yafai, who was arrested by the ATS in 2016.

A bench headed by Justice DY Chandrachud said it was legitimate to continue the investigation by ATS Nanded before NIA Mumbai took over.
