Simultaneously, the Supreme Court set aside Rajasthan HC’s decision of 2019, which overturned the termination of the service of an employee of the State Electricity Department for hiding a criminal case.

Rajasthan Rajya Vidyut Prasaran Nigam Limited had challenged the High Court’s decision. In this case, the employee, while applying for the job, was not aware of the criminal case in which he was convicted.

A bench of Justices MR Shah and Bopanna said the question is not whether an employee was involved in any dispute and whether he was subsequently acquitted or not, but it is a question of ‘confidence’.

An employee who makes a false declaration at the outset cannot be relied upon and the employer cannot be coerced into retaining such an employee.

The Bench hearing the matter said that the person has broken the trust of the company by hiding information about the criminal case or giving false affidavits. This is a matter of credibility.

The court said that when the applicant commits such fraud at the very beginning of the job, there will always be a doubt in his mind that the employer cannot trust him in the future.
