Former Supreme Court judge Justice Sanjay Kishan Kaul sheds light on the overlooked plight of 4.5 lakh displaced Kashmiri Pandits and the political complexities hindering their narrative.

Kashmiri Pandit: ‘There was no big vote bank’ Justice Kaul said – that is why the truth of displaced Kashmiris could not come out.

Former Supreme Court judge Justice Sanjay Kishan Kaul has said that very little was said about the 4.5 lakh Kashmiris displaced from the valley with the advent of militancy, due to which their entire truth was not revealed.

This probably happened because they were not such a big vote bank that any kind of political interference would have been done in their case.

Justice Kaul was part of the Constitution bench of the Supreme Court which had upheld the Central Government’s decision to remove Article 370 from Jammu and Kashmir. They said,

People from different communities lived together before peace was disrupted due to insurgency and they do not understand how the situation ‘gradually deteriorated’.

Justice Kaul himself is a Kashmiri Pandit and feels that after more than 30 years of unbridled violence, the time has come for the people to move forward.

Did Justice Sanjay Kishan Kaul say anything?

Justice Kaul also referred to the decision of the Constitution bench headed by Chief Justice DY Chandrachud and said,

It was a unanimous decision. This means that we all must have thought that this is the right path. There is no doubt that every decision, especially an important one, is debated.

There will be people who have a different viewpoint, but it doesn’t affect me, because a decision is an opinion in a situation. We should not be too sensitive about it.

The judge himself should decide about the post after retirement.

Public opinion is divided on whether former judges of constitutional courts should take up government duties after retirement.

Meanwhile, Justice SK Kaul has expressed the view that those who have been offered such responsibility should be allowed to make decisions themselves.

He said it was up to the judges of the constitutional courts to decide what to do.

Let us tell you, on one hand, former Chief Justices of India – Justices JS Khehar, RM Lodha, and SH Kapadia had announced that they will not take any post after retirement.

At the same time, another CJI Justice Ranjan Gogoi was nominated to the Rajya Sabha after retirement. Former CJI P Sathasivam was also made the Governor of Kerala after his retirement.

Sometimes the issue of air pollution becomes political.

Justice SK Kaul said the issue of air pollution is sometimes treated as a ‘political’ issue. He said that the courts should not do the work of the executive, but should put pressure on the executive to do its work.

When they passed the order, the authorities concerned took several steps to curb the air pollution that affects the National Capital Region every winter.
