SC People Who Convert Will Not Get Benefits Of Reservation

SC people who convert will not get the benefits of reservation. SC people who convert to Islam or convert to Christianity cannot ask for the benefits of reservation.

Union Law Minister Ravi Shankar Prasad has recently made an important statement in the Rajya Sabha regarding the reservation.

In response to a question posed by BJP leader and Rajya Sabha member GVL Narasimha Rao, he clarified that the Scheduled Castes who have converted to Islam or Christianity cannot claim the benefit of reservation in government jobs.

Not only this, these people will not be considered eligible to contest the seats reserved for Parliament and Assembly. Only Hindu, Sikh, and Buddhist voters will be eligible to contest from a seat reserved for Scheduled Castes.

In this context, Ravi Shankar Prasad also clarified that there is no need to amend the Representation of People Act to prevent members of scheduled castes and tribes who have converted to Islam and Christianity from contesting the Parliament or Assembly elections.

Because to believe in Hinduism there is already a clear division in the Act between those who have adopted Islam and Christianity.

It is clear from this statement that there is a clear distinction between Dalits adopting Islam and Christianity and Dalits under the larger Hindu religion.

If over time, the process of implementing this statement starts without any hindrance in the executive and the legislature, the conversion of Hindus will almost stop and nationalism will become stronger.

Since most Christian and Islamic institutions get foreign funds to shed the roots of Hinduism and Indian nationalism under the pretext of education and health, this process will be stopped to a large extent.

According to Article 15 of the Constitution, a nation cannot discriminate against any citizen on the basis of religion, caste, sex, and place of birth. In this context, there are contradictions in the constitution.

According to the third article of the Constitution, Scheduled Caste Order 1950, also known as the Presidential Order, no person other than those who follow only Hinduism will be considered in the category of Scheduled Castes.

In this perspective, there is a clear dividing line between Dalit and Hindu Dalits from other religious communities, which distinguishes equality and social justice.

In the same sequence, for the last five decades, Dalit Christians and Dalit Muslims have been struggling, demanding the rights given to the Hindu Scheduled Castes.

In this regard, the report of the Ranganath Mishra Committee had advocated removing this distinction. But this was not possible without an amendment to the constitution.

In the year 2015, the Supreme Court said in a judgment that once a person becomes a Christian or Islamist by giving up Hinduism or vote, then being a Hindu ends his inefficiencies of being socially, educationally, and economically weak.

Therefore it is not necessary to give him protection. In this sense, he will not be considered a Scheduled Caste person either. While giving a statement in Rajya Sabha, Ravi Shankar Prasad has also presented this fact.
