Mehbooba Did Not Get Help Even From High Court For Passport

Peoples Democratic Party President and former Chief Minister Mehbooba Mufti did not get any help from the High Court for her passport. The High Court has refused to interfere in it, terming it a case outside its jurisdiction.

Not only Mehbooba Mufti but also her mother Gulshan Mufti has refused to give her passport on the basis of the negative reports of the CID wing of Jammu and Kashmir Police.

The CID has termed the PDP President’s foreign trip a threat to national unity and security.

It is noteworthy that Mehbooba Mufti filed a petition in the Jammu and Kashmir High Court last week in view of the delay in the process of issuing passports.

While hearing the matter, a bench of Justice Ali Mohammad Magare in the High Court dismissed his petition.

Justice Ali Mohammad Magare dismissed the plea saying that in my opinion, this court cannot give any instruction to issue a passport in favor of the petitioner.

This court does not have much authority in the matter of issuing passports in the case of a particular person. The court can only ask the concerned institution to expedite the process of issuing passports to the applicant on the basis of the relevant rules.

Earlier, the Regional Passport Officer Srinagar while submitting a report of the ADGP CID Jammu and Kashmir in the High Court, said that the CID has denied the recommendation of issuing passports to Mehbooba Mufti.

According to the rules, the police investigation report is mandatory for passports. Mehbooba Mufti’s passport application is rejected under sub-section two-C of section six of the Passport Act 1967, based on the CID report.

Mehbooba Mufti applied for the issuance of passports on 11 December 2020. Mehbooba Mufti has been told that if she disagrees with this decision.

She can apply to the Joint Secretary and Chief Passport Officer, Ministry of External Affairs, Patiala House, New Delhi within 30 days.

Mehbooba Mufti has expressed her reaction to the court verdict and the CID report on her tweeter handle saying that the Passport Office has refused to issue me a passport based on a CID report.
