SC Strict On The Custody Of Mehbooba Mufti, Seeks GOI Reply

SC strict on the custody of Mehbooba Mufti said – Imprisonment cannot be forever, tell how long. The SC strict on the detention of former J&K CM Mehbooba Mufti, Tuesday heard a petition seeking her release.

Mehbooba Mufti’s daughter Iltija Mufti had requested the Supreme Court to amend the petition filed against the imprisonment of her mother under the Public Safety Act (PSA).

Hearing this, the court sought a response from the Jammu and Kashmir administration. Asked how much custody can be done under Public Safety Act? How long will Mehbooba be kept in custody?

The Supreme Court asked Solicitor General (SG), Tushar Mehta, how long and under which order the Center wanted to detain former J&K CM Mehbooba Mufti. At this SG Tushar Mehta asked for some time and said, we will reply to the court on these issues within a week.

At the same time, let me tell you that Iltija had requested the Supreme Court to allow her mother to start political activities. To this, the court said that PDP leader Mehbooba Mufti should request the authorities to attend party meetings.

The Supreme Court held that detention cannot be held forever. At the same time, the SC has allowed Iltija Mufti, her brother to meet her mother Mehbooba Mufti. Explain that in July, the detention of the mufti under the PSA was extended by three months.

Mufti and many other leaders of Kashmir, including Farooq Abdullah, were placed under house arrest after repealing Article 370 of the Indian Constitution, which gave special status to the erstwhile state.

Earlier, the detention of the former J-K CM was extended for three months on 5 May. Farooq and son Omar Abdullah were released from detention in March.

Let me tell you that Iltija had filed a petition saying that her mother is the president of a political party. Therefore, they should be allowed to discharge their responsibilities.

They should be allowed to meet and interact with their people, party officials, workers, and common people. He should be allowed to visit various places including his constituency so that he can sit and talk among the people.

Mehbooba was taken into preventive custody on August 5, 2019. Subsequently, in February this year, he was arrested under the PSA. Iltija had said that she had challenged the decision of her mother to be held captive under the PSA in the Supreme Court.

She appealed that the Supreme Court directs the Jammu and Kashmir State Administration to give Mehbooba Mufti an opportunity to meet her family members and relatives five days a week.

Apart from this, the landline phone in her house should be restored. The new petition states that the dossier issued for detention is useless, unconstitutional, and baseless. Subsection 3B of Section 83 of the Public Safety Act has also been violated by misuse of the law.
