The Supreme Court on Friday said that the courts should issue a reasonable order to provide protection from arrest to the person while rejecting the anticipatory bail plea.

The apex court said that when such orders are issued, the courts should provide the investigating agency, the complainant.

The remarks were made by a bench of Chief Justice NV Ramana, Justice Suryakant, and Justice Anirudh Bose in a judgment delivered on two petitions challenging the Allahabad High Court’s order.

The High Court had rejected the anticipatory bail petitions of the accused in these two separate cases, but granted protection from arrest for 90 days to surrender to the trial court for regular bail.

The apex court upheld the authority of the High Court, stating that such discretionary powers cannot be exercised in an uncontrolled manner.
