The Supreme Court gave an important decision on Friday in view of the Assembly elections.

The court has given an order to the state governments, clarifying that the state election commissioners are mandatory to be independent persons.

It also said that no such person can be appointed in the state who is employed in a post under the ruling government.

According to the court, appointing any person associated with the state government as an election commissioner is against the Constitution of India.

Today, the court heard the case of giving additional charge of the State Election Commissioner to the Secretary to the Government of Goa and gave this decision.

The court said that how can a person holding a post in government be given the post of state election commissioner. The case was heard by Justice RF Nariman.

He questioned the Goa government. The court said that in a democracy, the independence of the Election Commission cannot be compromised.

The court said that handing over an additional charge of state election commissioner to a person holding a post in government is against the constitution.

He said that the way in which the post of State Election Commissioner has been given to the Secretary to the Government in Goa is very disturbing.

A public servant, who was in employment with the government, is in charge of the Election Commission in Goa. The government official tried to reverse the High Court verdict regarding holding panchayat elections.

Maharashtra and Madhya Pradesh had also announced to bring such a law, while Jharkhand is busy preparing.
