UP Government Withdraws 77 Cases Of Muzaffarnagar Riots

UP government withdraws 77 cases of Muzaffarnagar riots, a status report filed in Supreme Court.

The UP government has withdrawn 77 cases related to the 2013 Muzaffarnagar riots in Uttar Pradesh.

Most of these cases are related to the charge of dacoity under Section 397 of the IPC, which has a provision of punishment up to life imprisonment.

The state government has also not given any reason for withdrawing the case under Section 321 of CrPC. It has only been said that the administration has decided to withdraw the case after due consideration.

This information has been given in the report filed by the Nyayamitra in the Supreme Court on the basis of information received from various states of pending cases against former and present MPs and MLAs.

The report also states that a total of 51 former and sitting MPs, MLAs have pending money laundering cases against them.

There are pending CBI cases against 121 former and current MPs, MLAs. The Supreme Court will hear the matter.

A petition is pending in the Supreme Court of BJP leader and lawyer Ashwani Kumar Upadhyay. The court is considering the demand for early hearing of pending cases against MPs, MLAs.

On the last hearing, the Supreme Court had said in its interim order that no case under Section 321 shall be withdrawn without the permission of the High Court.

The Supreme Court has appointed senior advocate Vijay Hansaria as an amicus curiae to assist in the hearing in the matter.

Hansaria files report on this matter from time to time in the court and give suggestions to the court.

In this sequence, he has filed the 14th report on August 24, in which the details of pending cases against MPs, MLAs have been presented by various states and the central government.

The report said that according to information received from Uttar Pradesh, a total of 510 cases were registered against 6,869 people in five districts of the Meerut zone in the 2013 Muzaffarnagar riots.

Out of these 510 cases, charge sheets have been filed in 175 cases. Final reports were filed in 165 cases. 170 cases were expired. After this, the state government withdrew 77 cases through section 321 of CrPC.

UP government withdraws 77 cases: The report said that the government has not given any reason for withdrawing the case.

Many of these cases are of dacoity under Section 397 of the ICPC, in which there is a provision of punishment up to life imprisonment.

Hansaria and his junior colleague advocate Sneha Kalita have also attached a list of the cases withdrawn in the report.

Hansaria has urged the court that the High Court should examine the 77 withdrawn cases using the powers of revisional jurisdiction.

Apart from Uttar Pradesh, the report also details the cases withdrawn by the Karnataka government against MPs, MLAs.

The Karnataka government has withdrawn 62 cases. The state government has not given any reason for withdrawing the case.

It has only been said that the government has given permission to withdraw the case.

However, the Karnataka High Court has currently put an interim stay on the state government’s order of August 31, 2020, withdrawing 62 cases and the matter is still pending in the court.

Tamil Nadu has withdrawn four, Telangana 14 and Kerala 36 cases.

In the report, Hansaria has referred to the previous order of the court, in which it has been forbidden to withdraw any case without the permission of the High Court.
