The Center has taken a big decision regarding AFSPA i.e. Armed Forces Special Power Act 1958.

The Central Government has extended the Armed Forces Special Powers Act 1958 (AFSPA) for another 6 months in some ‘disturbed’ districts of Arunachal Pradesh and Nagaland.

This decision has been taken after reviewing the law and order situation in both the northeastern states. News agency gave this information quoting the Ministry of Home Affairs.

The Armed Forces (Special Powers) Act, 1958 has been extended by 6 months from today in areas falling under the jurisdiction of Namsai and Mahadevapur police stations in Namsai district, besides Tirap, Changlang, and Longding districts in Arunachal Pradesh, the Home Ministry said.

The ministry said that these areas have been declared as ‘disturbed’.

Not only this, the Union Home Ministry has extended the Armed Forces (Special Powers) Act, 1958 in nine districts and 16 police stations in four districts of Nagaland for a period of six months from today.

Explain that these areas have also been declared as ‘disturbed areas. It is believed that the government has taken this decision in view of the security in these areas.

What is AFSPA law?

45 years ago, the Indian Parliament enacted the ‘AFSPA’ i.e. Armed Forces Special Power Act 1958, which is a military law, which is applied in ‘disturbed’ areas.

This law gives some special powers to the security forces and the army. However, there has been opposition from the beginning.

What are these special rights?

After the warning, if any person breaks the law, or creates a disturbance, he may be subjected to the use of force till death.

Can be destroyed any shelter or structure from where there is a danger of armed attack.

Any unsuspecting person can be arrested without a warrant. Any kind of power can be used by him during the arrest.

Without a warrant, he can be searched by going inside someone’s house. Necessary force can be used for this.

The vehicle can be stopped and searched.

Army officers are given a legal shield for their legitimate deeds.

Only the central government of the army can intervene.
