The Supreme Court on Friday rejected a petition from the mosque side in the Gyanvapi case.
On behalf of the mosque side, a petition was filed in the Supreme Court to hand over the Gyanvapi case to some other High Court instead of the Allahabad High Court, which has been rejected by the Supreme Court.
The administrative decision of the Chief Justice of the High Court to withdraw the Gyanvapi case from the single-judge bench hearing in 2021 was challenged in the Supreme Court by the Anjuman Intejamia Masjid Committee.
The single-judge bench was hearing a plea challenging the maintainability of a suit seeking the opening of a temple at the site of the Gyanvapi Mosque in Varanasi.
What did the Supreme Court say?
A bench of Chief Justice DY Chandrachud, Justice JB Pardiwala, and Justice Manoj Mishra dismissed the petition after hearing the arguments of senior lawyer Huzefa Ahmadi, representing the mosque committee.
“We should not interfere with the order of the Chief Justice of the High Court,” the bench said.
“This is a common procedure in the High Courts. This should fall under the jurisdiction of the Chief Justice of the High Court.”
The Anjuman Intejamia Masjid Committee (AIMC) is challenging the withdrawal of the case from a single-judge bench and the transfer of it to another bench by the Chief Justice of the High Court.
Before dismissing the petition, the CJI considered the reasons for transferring the case and said that he did not want to hear it in open court.
Time till 17th November to file survey report.
On October 30, the Allahabad High Court adjourned the hearing on AIMC’s petition till November 8.
On November 2, the District Court had given time to ASI till November 17 to file the report of the ongoing survey in the Gyanvapi Masjid complex.
The ASI told the court that it has completed the survey of the Gyanvapi Masjid complex but needs more time to draft the report. ASI had to submit the survey report by November 6.
